Subject: Request for Status Update, Investigation and Prosecution on Unaccounted COVID-19 Funds
I. INTRODUCTION
I, Dr. Nana Jantuah, PhD, a citizen of Ghana and a Public Advocacy Lecturer, write pursuant to Article 21(1)(f) and Article 41(f) of the 1992 Constitution of Ghana, and the Office of the Special Prosecutor Act, 2017 (Act 959), to petition your offices on matters of accountability arising from COVID-19 pandemic expenditures under the former Minister of Health, Hon. Kwaku Agyeman-Manu.
II. FACTS ESTABLISHED BY OFFICIAL REPORTS
The following are matters of public record, contained in the Parliamentary Ad-Hoc Committee Report on Sputnik V (2021) and the Auditor-General's Report 2022:
a) Sputnik V Vaccine Procurement Breach:
That the Ministry of Health, under Hon. Agyeman-Manu, without Cabinet, Parliamentary, and Public Procurement Authority approval, contracted Sheikh Ahmed Dalmook Al Maktoum to procure 300,000 doses of Sputnik V vaccines at $19 per dose against the ex-factory price of $10.
That approximately USD $2,850,000.00 (GH¢16 million) was paid with majority of doses undelivered. A refund of USD $2,470,000.00 was subsequently announced.
b) Unaccounted AVAT/UNICEF Payments:
That the 2022 Auditor-General's Report revealed that the Ministry of Health paid USD $120,190,000.00 to UNICEF/AVAT for vaccines, but only USD $38,320,000.00 worth was received, leaving a variance of USD $81,870,000.00 unaccounted for.
c) General COVID-19 Expenditure:
That the Centre for Development and Accountability (CDA) and the Auditor-General flagged approximately GH¢12.4 billion in COVID-19 funds and procurements as lacking transparency and accountability.
d) Frontiers Healthcare Services Contract:
That a private entity, Frontiers Healthcare Services, was granted an exclusive contract for mandatory COVID testing at Kotoka International Airport, accruing approximately USD $80.6 million in revenue under questionable procurement circumstances.
III. PRAYER / RELIEFS SOUGHT
In the interest of accountability and justice, I respectfully pray that your offices:
1. Provide a public status update on investigations into the aforementioned transactions;
2. Confirm whether the announced USD $2,470,000.00 Sputnik V refund was fully received into the Consolidated Fund and publish evidence thereof;
3. Investigate and account for the USD $81,870,000.00 AVAT/UNICEF variance and cause recovery of same if not justified by deliveries;
4. Provide a full accounting of the GH¢12.4 billion COVID-19 expenditure;
5. Investigate and, where culpability is established, prosecute Hon. Kwaku Agyeman-Manu and any other persons found culpable for procurement breaches, willfully causing financial loss to the state, and corruption-related offences;
6. Cause all unaccounted funds to be recovered to the state and apply sanctions under the Public Financial Management Act and relevant laws.
IV. CONCLUSION
The COVID-19 pandemic caused immeasurable loss to Ghana. Citizens lost lives, livelihoods, and paid taxes under extraordinary hardship through the COVID levy. To allow unaccounted billions to go unanswered is to betray the Constitution and the people of Ghana.
I trust in your mandate to fight corruption and protect the public purse.
Yours faithfully,
Nana Jantuah, PhD
